Terms of Use

TERMS OF USE

Website terms of use

Effective date: October 24, 2026 | Website: www.catalystcredit.ca

These Terms of Use govern access to and use of the Catalyst Private Credit website, operated by Catalyst Private Credit Partners, operating as Catalyst Private Credit (“Catalyst”, “we”, “us”, or “our”). They explain the conditions for using our website and how website information relates to a financing inquiry.

1. Using this website

By using this website, you agree to these Terms. If you do not agree, please stop using the website. To submit a financing request, you must have reached the age of majority in your jurisdiction. If you act for a business or another person, you must have authority to provide the information and make the request on their behalf.

Our Privacy Policy explains how personal information is handled. Agreeing to these Terms does not by itself authorize a credit check, disclosure to a prospective lender, or unrelated marketing. Required permissions are obtained separately.

2. Information and financing availability

Website content is provided for general information. It is not personal financial, investment, legal, tax, mortgage, or insurance advice and should not be relied on as advice about your circumstances. Obtain appropriate advice before committing to a transaction.

A service description, loan range, calculator result, illustration, or response to an inquiry is not an approval, offer, or commitment to lend. Financing depends on the application, available capital, acceptable security where required, applicable requirements, and final documentation. Services are available only where they may lawfully be provided. This website does not represent that Catalyst holds a particular licence or exemption unless expressly stated and verified.

Any preliminary term sheet is subject to the terms and conditions stated in that document. If it contains binding provisions, those provisions govern as written. The identity and role of the financing parties, fees, and obligations will be set out in the applicable transaction documents.

3. Amounts and timing

Amounts displayed on this website are in Canadian dollars unless otherwise stated. Published loan ranges indicate requests that may be considered and do not establish an entitlement to financing. Larger requests may be considered individually.

Turnaround times are targets for eligible, straightforward applications. Unless expressly stated otherwise, they run from receipt of a complete application and the required supporting information. A funding target includes the initial review period. Additional information, valuations, insurer or lender requirements, legal documentation, and closing conditions can affect timing. A target is not a guaranteed closing date.

4. Illustrations and insurance related financing

Examples identified as illustrative or hypothetical do not represent completed Catalyst transactions, actual client results, or guaranteed outcomes. Stock photographs do not identify Catalyst clients, employees, or financed properties unless expressly stated.

Premium financing, Immediate Financing Arrangements, and related bridges involve separate credit obligations. Any insurer acceptance, collateral assignment, subsequent advance, or tax treatment depends on the specific arrangement. Website information does not establish that another lender will reimburse a premium or repay a bridge.

5. Information you submit

Provide accurate information and update material changes. Submit another person’s information only with authority or another lawful basis. An inquiry does not create an advisory, agency, brokerage, or lending relationship; any such relationship must be established separately.

Do not send passwords, banking credentials, social insurance numbers, identification documents, medical records, or detailed financial statements through a general inquiry form. We will identify the information and submission method needed for a formal review.

6. Permitted use and intellectual property

You may use website material for lawful personal use or to evaluate business financing. Catalyst or its licensors own the content, design, trademarks, and other intellectual property. Reproduction or redistribution otherwise requires permission unless permitted by law.

Do not misrepresent your identity, submit unlawful material, interfere with security, introduce malicious software, attempt unauthorized access, or use automated tools that compromise the website or users’ information. We may reasonably restrict access to address misuse or protect the website.

7. Third party services and links

External websites and tools have their own operators, terms, and privacy practices. A link or reference does not establish an endorsement, partnership, or financing commitment. Review the applicable terms before using an external service.

8. Website availability and responsibility

We take reasonable care with website content, but information may change or contain errors. To the extent permitted by law, the website is provided as available, without a warranty of uninterrupted operation or suitability for a particular purpose. We may correct, update, or temporarily suspend content or features.

To the extent permitted by applicable law, Catalyst is not liable for indirect or consequential losses arising from use of, or inability to use, the website. This clause does not exclude or limit responsibility for fraud, wilful misconduct, gross negligence, a breach of applicable privacy obligations, or any liability that cannot lawfully be excluded. It does not change rights or obligations under a signed financing agreement.

9. Governing law and changes

These Terms are governed by Alberta law and applicable federal Canadian law. Subject to any mandatory rights to bring a claim elsewhere, the parties submit to the non-exclusive jurisdiction of the courts of Alberta. Nothing in these Terms removes consumer, privacy, or other statutory rights that cannot be waived.

Updated Terms will be posted with a revised effective date and will apply prospectively. We will provide additional notice of material changes where required or appropriate. A finding that a provision is unenforceable does not affect the remaining provisions to the extent they can continue to operate lawfully.
